There is no single global answer to whether cryptocurrency is legal. A country may allow users to hold Bitcoin without applying the same rules to every Token, trading platform, or financial product. By 2026, major markets have increasingly shifted their regulatory focus from simply deciding whether crypto should be permitted to areas such as asset classification, platform licensing, stablecoins, customer asset protection, and anti-money laundering requirements. Crypto Regulations in the United States and European Union
As of 2026, the United States continues to apply different legal frameworks depending on the characteristics of the asset and transaction structure. In March 2026, the US SEC issued an interpretation explaining in greater detail how federal securities laws apply to certain crypto assets and transactions involving them. This reflects a regulatory approach that does not simply classify all cryptocurrencies in the same way.
The European Union has established a more unified regulatory framework through MiCA, the Markets in Crypto-Assets Regulation. MiCA introduces common market rules for certain crypto asset issuers, stablecoins, and crypto asset service providers. On July 1, 2026, the relevant MiCA transitional period came to an end, and ESMA required unauthorized service providers to wind down relevant activities in an orderly manner in line with regulatory requirements.
Both approaches show that compliance discussions have moved beyond the question of whether Crypto can exist toward more specific questions about which rules apply to particular assets and who is authorized to provide related services.
How Asia and Other Major Markets Regulate Crypto Assets
Vietnam is developing a clearer regulatory framework for crypto assets. Vietnam’s Law on Digital Technology Industry, Law No. 71/2025/QH15, took effect on January 1, 2026, bringing digital assets into the legal regulatory framework and establishing a basis for defining and managing crypto assets. At the same time, the Vietnamese government issued Resolution No. 05/2025/NQ-CP on September 9, 2025, launching a five-year pilot program for the crypto asset market covering issuance, market organization, custody, and related services. Under the pilot framework, only institutions licensed by Vietnam’s Ministry of Finance may provide relevant crypto asset market services and conduct related advertising and marketing activities. Market participants must also comply with anti-money laundering, cybersecurity, and data protection requirements.
Hong Kong operates a licensing regime for virtual asset trading platforms, and the Hong Kong Securities and Futures Commission maintains an official list of licensed platforms. Singapore regulates digital payment token services under its payments framework, while the MAS Financial Institutions Directory allows users to check service providers with the relevant permissions. South Korea’s Virtual Asset User Protection Act took effect in July 2024, focusing on customer asset protection, regulation of unfair trading practices, and market supervision. Japan has also long regulated crypto assets and related intermediary services through its financial regulatory framework. Dubai has established a dedicated virtual asset regulatory framework, under which businesses conducting regulated virtual asset activities must obtain the appropriate authorization.
These regulatory approaches vary across jurisdictions, but a common trend is greater emphasis on service provider licensing, anti-money laundering controls, customer asset protection, and market conduct supervision. Users should therefore check the latest information from regulators in their own jurisdiction before trading rather than relying on a static list of countries where cryptocurrency is considered legal.
